Cohabitation and Marriage Agreements
Cohabitation Agreements (referred to as “prenuptial agreements or a “pre-nup”), and Marriage Contracts are domestic contracts that define the rights, entitlements and obligations of the parties. If a relationship breaks down, the terms of a couple’s Agreement or Contract are relied on to reduce potential conflict in areas such as support and property division.
A domestic contract must satisfy the requirements set out in The Family Law Act for it to be valid.
